Letter of Invitation for Proposals Re: To Improve the Legal and Institutional Environment for Urban Land Privatization, Registration, and Exercise of Rights to Land RFP Ref: CA/MCA-M/MCC/PRP/CS/037/2009 The Millennium Challenge Corporation ("MCC") and the Government of Mongolia (the "Government") have entered into a Millennium Challenge Compact for Millennium Challenge Account assistance (the "Compact") to help facilitate poverty reduction through economic growth in Mongolia. The Government, acting through Millennium Challenge Account Mongolia ("MCA Entity"), intends to apply a portion of the MCC Funding to eligible payments under a contract for which the Request for Proposals (RFP) is issued. Contract payments are made from the United States Government directly, or through the MCA Entity independent Fiscal Agent. Any payments made under the proposed contract will be subject, in all respects, to the terms and conditions of the Compact and related documents, including restrictions on the use of MCC funding and conditions to the disbursements of MCC funding. No party other than the Government and the MCA Entity shall derive any rights from the Compact or have any claim to the proceeds of MCC Funding. This Assignment directly falls under the urban component of the Property Rights Project under the Compact that will improve the formal system for recognizing and transferring land rights, and issue fully marketable private land titles to ger area residents. A "Legal and Regulatory Strengthening Commission" was established in September 2008 through a signed memorandum of understanding for an initial period of 6 months to conduct a comprehensive evaluation of the legal, regulatory, bureaucratic and other issues, inefficiencies or obstacles that impact the ability of a Mongolian citizen to privatize and register land in a relatively efficient and cost effective manner. Representatives from government, civil society, and private sector institutions served on the Commission. The objective of this Assignment is to facilitate changes to laws, regulations, and administrative procedures that, in turn, will make it more efficient and cost effective for Mongolian citizens to privatize land, register land, and exercise their rights to land (use, transfer, mortgage, etc.). To accomplish this objective, the Consultant will review and improve recommendations prepared by the Commission, draft amendments to laws and regulations, develop a strategic approach to implementing these recommendations, execute the strategy, and conduct a limited amount of training. The MCA Entity now invites proposals to provide the consultant services referenced above ("Proposals"). More details on these consultant services are provided in the Terms of Reference. The Request for Proposal ("RFP") is open to all eligible entities or persons ("Consultants") who wish to respond. Consultants may only associate with each other in the form of a joint venture or in a sub-consultancy agreement to complement their respective areas of expertise to enhance their capacity to successfully carry out the assignment and so long as any association is otherwise formed in accordance with the terms of the RFP. A Consultant will be selected under the Quality and Cost-Based Selection (QCBS), the evaluation procedure for which is described in sections of the RFP in accordance with "MCC Program Procurement Guidelines" which are provided on the MCC website www.mcc.gov.
