Nathan seeks a Director of Policy and Business Environment for the upcoming Africa Trade and Investment Program (ATIP). This expected $400-750 million new program will work to expand African trade and investment in support of implementing the USG’s Prosper Africa initiative and USAID’s Private Sector Engagement policy. The Director will provide leadership, vision, management, and technical direction to navigate legal and regulatory barriers to help to unlock Africa’s growing markets, expand U.S.-Africa trade and investment relationships, and achieve development outcomes across priority sectors. The new activity will support trade, investment, and private sector development programming to drive transformational development outcomes in all sectors. The project will facilitate transactional support for sustained economic growth objectives, to include: 1) increased trade, 2) increased investment, 3) improved business environment, 4) leveraging strategic African, U.S., and international partners and resources, and 5) institutional support to USAID transactional advisors under the Prosper Africa initiative.

The Director of Business Enabling Environment and Trade will be a senior-level position reporting directly to the Project Director. This position will be responsible for coordinating and coordinate all technical assistance activities with field staff, short-term consultants, and Nathan home office personnel with respect to legal system and commercial legal transactional support. S/he may also be responsible for the implementation of additional specific technical tasks within the project (to be determined according to needs and expertise).

KEY RESPOSIBILITIES:

· Support strategy development in addressing regulatory compliance, supporting transactions, and engaging with private sector and public sector to identify opportunities to create an enabling environment for business and commerce;

· Oversee or directly lead the execution of activities that assist with strengthening laws, regulations, institutional capacities, and practices to create a business enabling environment for trade and investment transactions;

· Engage governments, regional organizations, US agencies, and private sector associations to develop, prioritize, and execute strategies to advocate for rules and administrative systems conducive for investment and trade between the United States and Africa;

· Provide technical and administrative oversight in the execution of studies, workshops, training, and other activities related to the business enabling environment activities undertaken by ATIP;

· Liaise with local government, USG partners, regional organizations, civil society organizations and other donors to coordinate activities and achieve the goals and objectives of the activity; and

· Undertake all other activities necessary to ensure proper oversight and management of highest-quality business enabling environment and legal analysis services under this project.

Qualifications & SKILLS:

· A law degree or an advanced degree in a field relevant to commercial legal transactions, administrative compliance, or legal and regulatory reform.

· A successful record supporting international business transactions, legal and regulatory compliance, or policy reforms across a range of sectors, with digital economy regulation preferred.

· At least 10 - 15 years of experience working in the field of trade and commercial law, investment climate reforms, or transactional support in Africa.

· Prior experience managing or overseeing the work of attorneys strongly preferred.

· Demonstrated experience and relationships with the US Government, African governments, regional and multilateral organizations in a context that is relevant to promoting a strong business enabling environment strongly preferred.

· Clear command of the diverse array of key legal instruments, institutions, and resources available to promote more efficient, transparent, and enforceable rules related to US – African commercial relationships and transactions.

· Fluency in English is required. Proficiency in French, Portuguese, or Arabic would be a distinct advantage.
