Project Background:

The purpose of the USAID-funded Iraq Governance and Performance Accountability (IGPA/Takamul) project is to advance effective, accountable, and transparent governance in Iraq. This USAID effort, implemented by DAI, works with the Government of Iraq (GOI) at all levels to better respond to citizen needs by supporting reform initiatives and Iraqi change agents on inclusive governance and public-sector transparency, accountability, and economy. “Reform initiatives” includes support to improve service delivery functions, public financial management, and open government initiatives. IGPA/Takamul supports the GOI and the citizens of Iraq in forming partnerships and collaborative efforts to solve problems jointly and has four (4) objectives:

1. Enhance GOI service delivery capacity

2. Improve public financial management

3. Strengthen monitoring and oversight of service delivery and public expenditure

4. Support Iraqi change agents (cross-cutting objective)

Purpose:

The International Public-Private Partnership Specialist will provide technical assistance and guidance on the completion of IGPA/Takamul assistance packages related to improving public-private partnerships.

Responsibilities and Key Tasks:

The International Public-Private Partnership Specialist’s responsibilities include, but are not limited to, the following in support of the Kurdistan Regional Government (KRG):

  • Facilitate a PPP conference to build capacity and consensus among government and private-sector stakeholders in the Kurdistan Region of Iraq (KRI). The conference may be supported by supplementary pre and/or post-conference workshops to secure additional buy-in.
  • Facilitate the establishment of a PPP unit within the KRG and build the capacity of unit members on the use of PPPs as a mechanism for improving the delivery of services, especially the ones related to water and electricity services.
  • Work with the KRG PPP unit to identify possible PPP engagements in the KRI to improve the delivery of services for citizens. Work with the unit to draft a PPP case study, develop PPP projects pipeline and design a pilot project, and begin implementation.

Responsibilities also include, but are not limited to, the following in support of the GOI:

  • Build the awareness and capacity of the relevant parliamentary committees and other government & private sector stakeholders by facilitating capacity and consensus-building workshops.
  • Develop an instructional manual for the implementation of PPPs in the GOI and conduct instructional and on-the-job trainings to operationalize PPP pipeline selection, design, and implementation.

Deliverables:

Under this scope of work, the consultant will contribute to performing, but not be limited to, the tasks specified under the following categories. Upon the consultation and approval of the Deputy Chief of Party, tasks may be performed simultaneously or in a different order than appear below based on the government counterparts’ timeline and progress.

Task (1) – Prepare for the KRG Conference

The consultant will prepare for the regional PPP conference, which will be held in Erbil. Preparing the conference will include the following:

  • Preparing the agenda for the conference, including determining the topics to be discussed, duration of the conference, the times and durations of the sessions and the speakers in the sessions.
  • Preparing the list of invitees
  • Sending out the invitations
  • Preparing the conference material in coordination with the identified speakers, including the case study(ies) on implemented PPPs in the KRI.
  • Coordinating with the legal consultant to present the findings of the legal analysis in the conference, and discussing the needed legal reforms to create an enabling environment for implementing PPPs to improve the delivery of services

Task (2) – Hold the KRG Conference

Hold a regional conference on the use and implementation of PPPs in the KRI. The objective of the conference is to raise awareness among the provinces about the prospects of using PPP as a mechanism to attract private investments to improve service delivery, and to identify specific opportunities for service improvement projects that can be implemented using PPP.

On the day of the conference, the following is to be presented:

  • The findings of the previously conducted As-Is assessment including the status of PPP in the KRI, the current legislations and the draft ones, who’s in charge and who’s involved, challenges and recommendations including reforms needed for better utilization of PPP to improve service delivery. What are the roles of different stakeholders, and the process for using PPPs. It will also include presenting the findings of the legal assessment previously conducted.
  • A presentation about PPP concepts, types and uses in general, and in provincial service delivery in specific.
  • The Case Study.
  • List of potential PPP opportunities.

The last segment of the conference will be an open panel discussion about the prospects of using PPP as leverage for service delivery improvement in the KRI.

Task (3) – Produce PPP regulatory framework.

Work with the KRG counterparts to produce a sound PPP regulation framework. The consultant should develop a framework per the best international practice to increase the KRG efficiency on the partnership functionality and optimize the resources available to the private sector partner in line with broader policy objectives. In turn, the regulatory framework to assure the private-sector protection from expropriation, arbitration of commercial disputes, respect for contract agreements, and legitimate recovery of costs and profit proportional to the risks undertaken.

Task (4) – Establish KRG PPP Unit

Work closely with key counterparts within the KRG Ministry of Planning (MOP) and other relevant government stakeholders to design recommended organizational structure, duties and responsibilities, standard operating procedures, and mission for the new KRG PPP unit.

Task (5) - Create standardized project pipeline methodology

The consultant to work closely with the key counterpart in KRG to establish internationally recognized PPP project pipeline steps and processes. The project pipeline is to enable the selection of the right improvement projects and to develop a valuable project pipeline to maximize the benefits and return investment. Train the MOP and the line ministries on the payoff matrix to prioritize projects that are the best fit for the public-private partnership.

Task (6) – Support the Selection and Implementation of a KRG PPP Pilot

The consultant will build the capacity of the PPP Unit to identify, prioritize, select and negotiate PPP pilot project focused on improved water or electricity service delivery. Consultant will work closely with the PPP Unit to design an implementation plan including feasibility study, timeline, milestone targets, and quality control processes.

Task (7) – Develop the GOI’s Consensus on and Capacity to Advocate for the Draft PPP Law

Provide technical support to the involved committees in the parliament by conducting PPPs workshops on the concept of partnership between the public and private sectors and it will target the relevant committees.

Task (8) – Build the GOI PPP Legal Framework

Collaborate with the MOP and other GOI counterparts to develop an instructional manual for PPP implementation. The consultant will facilitate technical workshops on PPP contract implementation to solicit inputs for the manual.

Task (9) – Support the Selection and Implementation of a GOI PPP Pilot

Work with the MOP and provinces to select a PPP pilot project. In order to achieve this, the consultant will conduct meetings and workshops to identify provincial-level capacity to manage a PPP pilot project in the water or solid waste sector. Once the province and project is selected in coordination with the MOP, the consultant will provide technical support in the preparation of a feasibility study with the concerned authority to implement the pilot project.

Qualifications:

  • Master’s degree or equivalent in a business administration, public policy, economics, finance or any other relevant area
  • Proven track record of implementing and managing similar projects
  • PPP experience in Middle Eastern and fragile states
  • Experience in cultivating and supporting win-win partnerships between private and public sector actors and leveraging private investment to promote economic strengthening
  • Solid understanding of international experience and good practice with respect to legal, policy, and institutional frameworks for PPPs and other forms of private participation in service delivery, and of relevant aspects of broader public investment and fiscal risk management
  • Expertise in Public- Private Partnership types and their implementation in service delivery, preferably in the areas of water and solid waste management.
  • Fluency in written and spoken English. Arabic fluency is preferable.
  • PMP certificate is preferable

Location and Reporting:

The International Public-Private Partnership Specialist will be based in Baghdad and Erbil, Iraq and will closely work with DCOP.

Conditions of Work Requirements:

Work and living facilities are in high security zones with frequent security drills and protocols and limited access to medical facilities. General work environment and living quarters requires ability to walk numerous flights of stairs on a daily basis. Security protocols require the individual in this position to be able to quickly climb multiple flights of stairs while wearing 30 lbs. of personal protective equipment, walk swiftly or run across uneven terrain without assistance, and enter and exit project vehicles without assistance
