Job Description

Objective and Purpose of the Assignment

The Guangxi Project Management Office (GPMO) will engage a qualified and experienced External Resettlement and Social Monitor under Tranche 3 of the MFF. The consultant will be engaged on an intermittent basis for the entire duration of Tranche 3 project implementation, under the supervision of the GPMO, for an estimated total input of 10 person-months (under the individual consultant selection method) during the proposed period of 1 July 2022 to 31 December 2024.

The consultant will provide external monitoring and technical assistance to build the capacity of the PMOs, Implementing Agencies (IAs), Project Implementing Entities (PIEs), and contractors to implement the Environment Management Plan (EMP), and ensure and verify compliance of subproject activities with ADB’s SPS (2009).

Scope of Work

  • (i)Independent monitoring of LAR activities completed for tranche 3 and confirm category B for IP including monitoring of social gender action plan (SDGAP) activities if necessary to verify that issues reported in the internal monitoring report, quarterly progress report and semi-annual progress report are in compliance with ADB’s safeguards and other relevant policies.
  • (ii)Confirm that the compensation provided to the villagers has been distributed to the affected villagers.
  • (iii)Monitor functioning of grievance redress mechanism.
  • (iv)Monitor and report on the process of public consultation and participation, particularly women, ethnic minorities and low-income people including stakeholder consultation in line with IP safeguards and SDGAP and provide advice to IAs and PIEs as required.
  • (v)Monitor and report on the various activities outlined in SDGAP and its progress including adequate budget support and trained staff to implement SDGAP.
  • (vi)Provide training to resettlement focal and SDGAP implementation staff.
  • (vii)Make recommendations and due diligence to resolve any issues or problems and provide advice to the subprojects in multi-tranches requested by IAs and PIEs.
  • (viii)Submit English external monitoring reports including record of grievances to the quality acceptable to the GPMO and ADB on semi-annual basis during project implementation period.
  • (ix)Conduct an external assessment of the extent to which resettlement and rehabilitation objectives are being met. Specifically, the objectives of the monitoring program are (a) to verify ongoing internal monitoring information, (b) to verify that there are no unanticipated LAR impacts in the second tranche of the project, (c) of land acquisition or involuntary resettlement activities completed prior to the project under Tranche 3, to verify that there are no outstanding compensation or resettlement issues, or unresolved grievances or related issues.
  • (x)If there are any unanticipated or outstanding involuntary resettlement issues, report these to the GPMO and ADB and prepare recommendations for corrective measures in accordance with ADB’s SPS (2009) and the project resettlement framework (see PAM) in close collaboration with those affected. Monitor agreed corrective measures. This will include confirming distribution of compensation to the affected persons (APs), and monitoring APs’ satisfaction levels and living standards, and submitting monitoring and evaluation reports to GPMO for review, follow-up and disclosure. Pay special attention to vulnerable groups, including women, the poor, and ethnic minority groups, to assess whether they have participated and fully regained their standard of living.
  • (xi)Conduct an external assessment to verify whether the indigenous peoples’ elements in the project design are being achieved, and the proposed activities and beneficial and mitigation measures in the indigenous peoples’ framework, SDGAP and ESMS are being complied with.
  • (xii)Analyze the socio-economic and poverty impacts of project activities under tranche 3 against the key indicators of the SDGAP, and verify the findings reported in the internal monitoring, quarterly and (semi-)annual progress reports and compliance with ADB’s safeguards and gender and development policies, other relevant, and domestic policies. This will include monitoring the budget and human resources adequacy to conduct these activities.
  • (xiii)Monitor and report on the process of public consultation and participation to ensure that stakeholders comply with the SDGAP and provide advice to the PMOs, IAs, and PIEs for their implementation as required.
  • (xiv)Monitor the functioning of the grievance redress mechanism (GRM), including case management and procedures, GRM database/filing and reporting. Visit the affected villages and groups regularly and interview the township government and IA to evaluate how any grievances are being handled. Meet complainants, and propose corrective measures for existing issues.
  • (xv)Provide training to the social safeguard focal points at the PMOs, IAs, and PIEs, and to all staff responsible for implementing the SDGAP.
  • (xvi)Submit external resettlement and social monitoring reports to GPMO and ADB with quality acceptable to ADB, in both English and Chinese, as outlined in the reports section below.
  • (xvii)Coordinate and collaborate with the project social and gender consultant on all monitoring activities under the SDGAP and relevant activities/indicators in the DMF; Review internal social monitoring reports to ensure good data review, collection and monitoring.
  • (xviii)Provide analytical recommendations to resolve any issues or problems on implementation of the SDGAP, and provide advice to PMO and IAs.
  • (xix) Assess the performance of IAs to implement plans.
  • (xx) Assess whether PMO and IAs are paying special attention to vulnerable groups, in accordance with the SDGAP including women, the poor, and ethnic minority groups to assess whether they have participated and benefited from the project.

Detailed Tasks and/or Expected Output

The External Resettlement and Social Monitor will submit the following deliverables:

  • (i)Semi-annual external resettlement and social monitoring reports, i.e. semi-annually until the project completion and annually until two years after the completion of any resettlement activities (where relevant). GPMO shall submit the external monitoring reports to ADB semi-annually for review and disclosure on ADB’s website.
  • (ii)A separate external monitoring report for IP and SDGAP development and a separate external monitoring report for land acquisition and resettlement.
  • (iii)Delivery of training to PMOs, IAs and PIEs as required.

The External Resettlement and Social Monitor will present her/his key findings and recommendations to the GPMO at least 2 days prior to the end of each monitoring period. The external monitor will submit monitoring reports (in English and Chinese languages) within 30 calendar days after completion of each monitoring activity. The external monitor is also required to revise the external resettlement and social monitoring reports based on comments received from the PMO and ADB and submit the revised reports within 15 working days. Payments will be released subject to submission of reports and other deliverables assessed as satisfactory by both the GPMO and ADB.

Photos, minutes of meetings, attendance sheets, held with various stakeholders will be attached in the reports. Documents obtained during monitoring will also be attached as necessary.

The expert will be engaged to offer external monitor consulting service by ICS method for the whole duration of project implementation. This consulting service will be financed by ADB loan and procured according to Procurement Guidance (2017 year) . It estimated that this service will last 2.5 years from Q3, 2022 to the project completion. During this period, the expert will offer extensive and necessary intermittent input.The total input of the consulting service will be 10 person-months to be delivered intermittently over the period of 30 months.

Minimum Qualification Requirements

The External Resettlement and Social Monitor should have strong expertise, extensive experience, and in- depth knowledge of social and gender analysis and management, and resettlement and indigenous peoples safeguard management. The consultant will (i) have a master’s degree or higher qualification in social development, anthropology or other relevant field; (ii) at least 10 years of relevant experience, familiar with Chinese resettlement, social issues as well as related policies and regulations; and (iii) fluent in English. Meeting these requirements, the expert who has IFI loan project related experience is preferred.
