What You’ll Be Doing

The Naval Agency of the Republic of Moldova (NARM), as the maritime administration in Moldova, has the role of ensuring effective implementation of state policies relating to maritime transport, improving, and monitoring compliance with the legal and regulatory framework, ensuring the safety of ports and inland waterways, and the quality and safety of the navigation of vessels.

According to its functional responsibilities, NARM is responsible for the implementation of international legislation, including EU accession requirements and international conventions, into Moldova’s legal system. The government decision establishing NARM, besides others. sets forth the following responsibilities related to certification of navigating personnel:

  • Organize exams for assessing the capacities of seafarers for issuing licenses and certificates of competence
  • Grant, reconfirm, suspend, and/or revoke licenses and certificates of competence for seafarers
  • Register and maintain records of seafarers’ licenses and certificates
  • Issue and renew identification of seafarers, and of the staff piloting the vessels for embarkation and disembarkation
  • Coordinate and authorize companies which recruit and employ maritime and inland waterway staff on vessels flying the flag of the Republic of Moldova or foreign flag
  • Oversee the recruitment, training, and licensing of vessel pilots
  • Approve and certify training requirements, continuing education, and assessments of trainers and trainees/seafarers/inland waterways staff

The Republic of Moldova lacks the necessary legal framework for the training and professional certification of navigating personnel and for the mutual recognition of Moldovan-issued documents. NARM must develop a new, progressive legal framework that conforms with international conventions and EU legislation, aligning with international best practices.

The SoW aims to develop comprehensive legislation transposing the provisions of the EU legislation, as per list below:

  1. Directive (EU) 2020/12 of 2 August 2019 supplementing Directive (EU) 2017/2397 of the European Parliament and of the Council as regards the standards for competences and corresponding knowledge and skills, for the practical examinations, for the approval of simulators and for medical fitness
  2. Commission Implementing Regulation (EU) 2020/182 of 14 January 2020 on models in the field of professional qualifications in inland navigation
  3. Commission Delegated Regulation (EU) 2020/473 of 20 January 2020 supplementing Directive (EU) 2017/2397 of the European Parliament and of the Council regarding the standards for databases for the Union certificates of qualification, service record books and logbooks
  4. Council Directive 2014/112/EU of 19 December 2014 implementing the European Agreement concerning certain aspects of the organization of working time in inland waterway transport
  5. Council Directive 87/540/EEC of 9 November 1987 on access to the occupation of carrier of goods by waterway in national and international transport and on the mutual recognition of diplomas, certificates, and other evidence of formal qualifications for this occupation
  6. Directive (EU) 2017/2397 of the European Parliament and of the Council of 12 December 2017 on the recognition of professional qualifications in inland navigation

Responsibilities and Tasks

  • The Maritime Expert will develop legal drafts transposing the above-mentioned EU legislation on training requirements, certifications, and qualifications of personnel navigating on inland waterways and mutual recognition of documents and certificates.
  • The Maritime Expert will implement the following activities and tasks:
  • Review the national standards and legislation in the domain, if existing, to identify relevant Moldovan legislation that should be amended and/or completed
  • Lead working meetings and consultations with MIRD, NARM, and other state institutions, in coordination with MISRA
  • Referencing EU requirements will develop legal drafts to be implemented by NARM and MIRD specifically

The Maritime Expert will work on the following deliverables primarily remotely, with regular monthly and ad hoc reporting to MISRA on the progress of the work. Up to two trips to Chisinau, Moldova may be required: at the inception stage and near the conclusion of the assignment.

Deliverables

  • Primary and/or secondary legislation acts (draft laws, Governmental Decisions, regulations, ministerial orders, etc.) laying down the provisions for professional qualification, examination, training, and mutual recognition of the documents issued for personnel navigating on inland waterways, referencing EU Regulations and Directives (Monthly report on the progress will be submitted)
  • Deliverables presentation to the beneficiaries, MIRD and NARM

Required Skills and Qualifications

  • University degree in law and/or maritime transport sector
  • At least 10 years of working experience in a maritime administration
  • Experience in working within a training center for reporting on personnel is desired, but not a priority
  • Sound knowledge of EU legislation governing maritime and inland waterways
  • Sound knowledge of international conventions in the field of waterways transport
  • Knowledge of training requirements and/or professional qualification of navigating personnel is desired
  • Experience in legal drafting
  • Experience in working within technical assistance projects is desired
  • Writing and speaking skills in English required
  • Writing and speaking skills in Romanian are desired but not a priority
