Job Description

The specific objectives are: Supervision of works contract Defects Liability Period.

Requested services

  • Act as the Supervising Engineer during the works Defects Liability Period (DLP);
  • Supervision of quality of works, materials and workmanship related to the Contractor’s defects removal works.
  • Inspection of the removal of defective works by the Contractor.
  • Inspection of sites upon receiving information from Contracting Authority (Beneficiary) about defective works.
  • Documentation of the warranty issues related to the implemented works.
  • Ensuring compliance with works contract technical specifications and Ukrainian laws.
  • Conducting meetings with Contracting Authority and Contractor, if necessary; taking the minutes of the meetings.
  • Issuing notifications and instructions to the Contractor.
  • Solving disputes related to the defects removal issues.
  • Approving the release of retention moneys.
  • Issuing the Final Acceptance Certificates.
  • Checking the draft Final Statement of Account submitted by the Contractor.
  • Preparing the Final Statement of Account.
  • Preparing the Contract Completion Report. This report shall be ready not later than 2 months after the issuing of Final Acceptance Certificate.
  • Assist and give an advice to the EU Delegation in all relevant meetings and correspondences with the Works Contractor;
  • Assist the EU Delegation by providing advice in the event of any disputes on claims (by Works Contractor) or penalties (imposed by the EU Delegation) with the Works Contractor;
  • The Consultant should attend in the meetings in the EU Delegation’s offices inKievto provide advice to the EU Delegation in any discussions and negotiations with the Works Contractor as required;
  • To assist the EU Delegation with any other activities where the Consultant’s skills, knowledge and experience may be beneficial;
  • Discuss with all relevant actors all submitted documents from the Works Contractor and agree, where necessary, appropriate actions and responses;
  • Check the content and completeness of the final documentation;
  • Provide instructions and advices to the beneficiary staff in operational aspects of the works;
  • Submit a quarterly report to the EU Delegation, summarizing all undertaken actions, ad-hoc report if required and a final report (the last quarterly report replaced by the final report).

At home office the Consultant should be available by E-mail or telephone to give advice and support with the issues related to the DLP.

The above tasks are not exhaustive and the consultants will be expected to contribute for the benefit of the project wherever their skills may be useful.

EXPERTS PROFILE

Two Experts are required to carry out the services for total of up to 80 working days.

Senior Expert, Supervisor – up to 30 working days:

Qualifications and skills

  • Education of at least to Masters degree (where a university degree has been awarded on completion of four years study in a university institution), or equivalent professional experience of 15 years in Civil Engineering (Construction) or associated fields;
  • Language skills: English and Russian/Ukrainian. It is specifically forbidden to replace language skills required from the expert by an interpretation and / or translation service.
General professional experience
  • 10 years or more relevant experience in the fields mentioned above

Specific professional experience

  • Experience as supervisor of at least one construction project in EC financed project.
  • Experience in at least one contract governed by the PRAG.
  • Experience as a supervisor inUkrainewould be an asset.

Junior Expert, Supervisor’s Representative – up to 50 working days:

Qualifications and skills

  • Education of at least to Masters degree (where a university degree has been awarded on completion of four years study in a university institution;
  • Language skills: English and Ukrainian/Russian. It is specifically forbidden to replace language skills required from the expert by an interpretation and / or translation service.
General professional experience
  • At least 3 years of relevant experience in the fields mentioned above

Specific professional experience

  • Experience as supervisor or supervisor’s representative of at least one construction project in EC financed project.
  • Experience in at least one contract implemented inUkraine
  • Knowledge of Ukrainian construction rules and legislation

LOCATION AND DURATION

Starting period

Envisaged start date 21st December 2011. The Consultant will be informed on time on the specific date.

Foreseen finishing period or duration

Indicative end date: 31 October 2012

Planning

The indicative time schedule will be discussed and agreed with the Contracting Authority at the beginning of mission of the Expert(s). However a degree of flexibility will be required by the consultant in order to meet the actual needs. Briefing and debriefing shall take place at the EU Delegation

Location(s) of assignment

Experts shall be based inUkrainewhen providing their services except for the maximum 50% of home working days in total. Supervisor – up to 5 missions toSverdlovsk. Supervisor’s Representative – up to 10 visits toSverdlovsk. A quarterly missions toSverdlovskare obligatory, other missions toSverdlovskundertaken when required.
