After the approval of Law 10/2020 of 24 August, which establishes the legal framework for Disaster Risk Management and Reduction, there was a need to define the competencies, organization and functioning of the coordinating entity for Disaster Risk Management and Reduction.
Through Presidential Decree No. 41/2020 of December 28, the National Institute of Management and Disaster Risk Reduction was created, briefly designated by INGD as the Coordinating entity for the Management and Reduction of Disaster Risk, revoking decree 38/99 of June 10 which creates the National Institute for Disaster Management (INGC).
The National Institute for Disaster Risk Management and Reduction is the result of an institutional transformation process that took place in this area, starting in the 1980s until now.
In fact, in 1980, with the objective of providing a quick and efficient response to situations of natural disasters, guiding and coordinating the efforts of the various structures of the State Apparatus involved in combating natural disasters, through Presidential Decree No. 44/80 , on 3 September, the Coordinating Council for the Prevention and Combat of Natural Disasters was created, with the Minister of Planning as President and the Minister of Internal Trade as Vice-President. This same legal diploma created the Department for the Prevention and Combat of Natural Disasters ( DPCCN ) integrating it into the former National Plan Commission (CNP).
This situation prevailed until 1999, when, through Presidential Decree No. 4/99, of 10 June, the Coordinating Council for the Prevention and Combat of Natural Disasters, as well as its executive body, the Department for Prevention and Combat, was extinguished the Natural Calamities. In its place, Presidential Decree No. 5/99, of 10 June, created the Coordinating Council for Disaster Management (CCGC), whose composition was later changed by Presidential Decree No. 26/2005, of 1 December.
Due to this, in the same year (1999), the Department was transformed into an Institute , thus creating, through Decree No. 38/99, of 10 June, the National Institute for Disaster Management (INGC), becoming to be “ a public institution, endowed with legal personality, administrative and financial autonomy and its objective is the direction and coordination of disaster management, namely, in prevention and relief actions for victims in risk areas or affected by disasters ” [3 ] and subordinate to the Ministry of Foreign Affairs and Cooperation (MINEC) [4] .
In 2005, through Presidential Decree n° 27/2005, of December 1st, the subordination of INGC was transferred from the Ministry of Foreign Affairs and Cooperation to the Ministry of State Administration (MAE). Taking into account this new domicile in terms of INGC's subordination, an amendment was immediately made to its creation Decree, through Decree No. 49/2005, of 14 December, which essentially redefined its nature and attributions, having it was immediately withdrawn its legal personality and financial autonomy .
This framework was changed in 2007, through Decree No. 52/2007, of 27 November, which approved the current Organic Statute of INGC where, in addition to stating that INGC is supervised by the Minister who oversees local administration, legal personality is restored by stipulating that it is an “institution of public administration endowed with legal personality and administrative autonomy, dedicated to the prevention and mitigation of natural disasters”.
Therefore, INGC evolved from a situation of an integrated Department, to a subordinate Institute, with legal personality, and even a supervised Institute. In terms of institutional insertion, it went from the Ministry of Planning (National Planning Commission) to the Ministry of Foreign Affairs and Cooperation, to the Ministry of State Administration and Public Service.
