General Provisions

1. The Ministry of Labor, Migration and Employment of the Republic of Tajikistan (hereinafter – the Ministry) is the central executive body of state authority, responsible for the development and implementation of a uniform state policy and normative legal regulation in the field of labor migration, labor market, employment, standard of living , initial vocational education and adult education.
2. The Ministry is coordinating the activities of the defined in the control circuit and system organizations.
3. In its activities the Ministry is guided by the Constitution, constitutional laws of the Republic of Tajikistan, the laws of the Republic of Tajikistan, decisions Majlisi Namoyandagon of the Majlisi Oli of the Republic of Tajikistan, President of Tajikistan, the Government of the Republic of Tajikistan, international legal acts recognized by the Republic of Tajikistan, as well as these Regulations.
4. The Ministry carries out its activities in cooperation with the central executive authorities, local executive bodies of state power, international, non-governmental organizations and other organizations.

Powers

5. The Ministry in the specified area the following powers:

Develops draft laws and normative legal acts on labor, migration, employment, living standards, initial vocational education and adult education, as well as the work plan and forecast performance of the activities of the Ministry and submits them to the Government of the Republic of Tajikistan;

In accordance with and pursuant to the Constitution of the Republic of Tajikistan, Republic of Tajikistan, laws, decisions of the President of the Republic of Tajikistan and the Government of Tajikistan in the established sphere of activity carries out the following tasks:

In the field of labor relations and the standard of living:

  • In cooperation with relevant ministries and agencies developing proposals on the main priorities of the state policy in the field of labor and living standards;
  • Examines, analyzes and evaluates the state of the population;
  • Developing measures to ensure the stabilization and improvement of living standards through income generation policy;
  • In cooperation with relevant ministries and agencies prepare a proposal for the minimum wage, benefits and grants;
  • Contributes to the Government of the Republic of Tajikistan proposals to improve the system of compensation, benefits, and the protection of personal incomes from inflation;
  • Develop guidelines to determine the calculation of the subsistence minimum of different socio-demographic groups, carries out its calculation, as well as the expertise of calculations of the subsistence minimum;
  • In cooperation with relevant ministries and departments prepare proposals for improving the system of social partnership, providing methodological guidance on the operation of regional agreements, sectoral (intersectoral), collective agreements, facilitate the settlement of collective labor disputes, on issues related to the competence of the Ministry;
  • Develop and submit for approval to the relevant body and leads to the established procedure national classifier of professions of workers and workers’ positions;
  • Registers and monitors the implementation of regional and sectoral (tariff) agreements on socio-economic and labor relations;
  • Participates in the drafting of the General Agreement between the Government of the Republic of Tajikistan, the Tajik Association of Employers and workers’ representatives, to submit proposals for the implementation of the action plan of the agreement;
  • Develop proposals for improving the system of remuneration of workers in the framework of collective agreements and collective bargaining agreements;
  • Carries out billing jobs, professions and positions, developing a legislative basis for the valuation and remuneration;
  • Develop proposals for improving the regional regulation of wages and compensation system, taking into account climatic and socio-economic factors;
  • Approves regulations on labor, a single tariff-qualification reference works and professions of workers qualifying reference positions, instructions, explanations, advice on organization, regulation and payment of wages;
  • Participates in the development and implementation of measures for improvement of the civil servants pay system, public sector employees, as well as the monetary allowance of servicemen and persons equated to them;
  • Participates in establishing the size of tariff rates and salaries for individual posts and categories of public sector employees in relation to the wage conditions laid down by the Government of the Republic of Tajikistan;
  • In coordination with the Ministry of Finance of the Republic of Tajikistan establishes minimum standards and procedure for reimbursement of expenses under workers direction to perform the installation, commissioning and civil works, refresher courses, as well as for mobile and itinerant nature of the work, for the production of works in shifts and fieldwork, a permanent job in the way;
  • In coordination with the Ministry of Finance of the Republic of Tajikistan establishes the conditions of remuneration of employees who are engaged in rescue and other urgent works on liquidation of consequences of emergency situations;
  • Develops and submits to the Government of Tajikistan list of productions, works, professions and positions with harmful working conditions, giving the right to additional leave, reduced working hours, receive free preventive nutrition;
  • Carries out the state management of labor protection and coordinates the work of ministries and agencies in this regard;
  • In coordination with the relevant ministries and agencies develop and approve inter-branch rules and organizatsionnometodicheskie documents on labor protection;
  • Participates in the development of national and regional programs to improve conditions and labor protection;
  • Developing a list of heavy jobs and jobs with harmful and dangerous working conditions, which prohibits the employment of women and minors and submit to the Government of Tajikistan;
  • Together with the state statistical bodies develop and approve forms of state statistical reporting indicators of conditions and labor protection, industrial accidents and occupational diseases;
  • Develops and submits to the Government of Tajikistan procedures for investigating industrial accidents and occupational diseases;
  • Develops and submits to the Government of Tajikistan industry norms issue of special clothing workers, special footwear and other personal protective equipment;
  • Develops and submits to the Government of the Republic of Tajikistan, the procedure for granting benefits to employees in connection with the heavy, harmful or dangerous working conditions;
  • Approve the rules and regulations on labor protection, as well as organizational-methodological and general technical requirements for labor protection;
  • Develops and submits to the Government of the Republic of Tajikistan proposals on improvement of conditions of labor protection, state regulation of working hours and rest periods for certain categories of workers;

In the field of migration:

  • Is developing a program for the development of public policies on migration, will organize work on their implementation;
  • Organize at the national, regional and local levels work on the development of employment statistics, the formation, maintenance and use of the data bank of vacancies and labor supply;
  • Provides methodical support of the development and implementation of targeted programs to promote employment of job seekers and the unemployed, including through the development of entrepreneurship and self-employment, the direction of the unemployed at the time and public works, as well as the application of flexible forms of employment;
  • Take the necessary measures to prevent and reduce informal employment, together with the relevant government authorities;
  • Controls and coordinates the vocational guidance and profkonsultatsiyu youth and the unemployed according to the needs of internal and external market;
  • Submit proposals for the establishment of quotas for the employment of citizens in need of social protection and non-competitive in the labor market;

In the field of initial vocational education and adult learning:

  • Develops projects of standards and state standards of initial vocational education and adult learning, and ensures the implementation and enforcement of these standards supervision;
  • Provides the necessary conditions to meet the needs of citizens in obtaining initial vocational training in key areas of public benefit activity according to the list of professions and specialties of primary vocational education of the educational standard of primary education;
  • In the established order develop and approve in coordination with the relevant ministries and departments of educational plans and programs of initial vocational education and adult education;
  • Organizes the centralized management system of vocational training, advanced training and retraining of the unemployed;
  • Taking steps to availability of initial vocational training and the adaptation of the system of initial vocational training level, especially the development and the professional education of citizens;
  • Develop and implement appropriate programs to meet labor market needs in professional staff with initial training;
  • Provides training, training through institutions of primary vocational education and adult education;
  • Organizes job training in training workshops, laboratories, educational sites (landfills), educational and experimental farms of initial vocational training institutions as well as enterprises in the shops, in their classrooms, building and other facilities;
  • Organizes the methodological support and the development of initial vocational education and adult education;
  • Organizes short courses of vocational training, retraining, further training and life skills training;
  • Develop and implement measures to strengthen the material base of educational institutions of primary vocational education and adult training with the involvement of domestic and foreign development partners and investors;
  • Organizes and monitors the quality of initial vocational education and adult education;

Participates in the established order in international relations in the field of specified activities.

6. Ministry to implement the powers established in its activities, it has the right to:

  • Carried out in the prescribed manner and competitions conclude state contracts for placement of orders for goods, works and services, including on carrying out scientific and research work for the needs of the Ministry;
  • To carry out guidance and assistance in the activities of local executive bodies of state power on matters within the competence of the Ministry;
  • To organize and coordinate the carrying out of research works in the field of labor migration and employment;
  • Organize training and skills development in the areas of labor, employment and migration;
  • In cooperation with other ministries and agencies to carry out targeted analysis and survey on labor issues, migration and employment;
  • Organize the reception of citizens on matters within the competence of the Ministry, to consider proposals, petitions and complaints from citizens and to take necessary measures on them;
  • To organize the implementation of measures for mobilization preparation and civil defense in accordance with the legislation of the Republic of Tajikistan;
  • To carry out an internal audit of target and efficient use of budgetary funds of the central office and in the budgetary organizations of the Ministry;
  • To request and receive in the prescribed manner by the relevant state bodies, local executive bodies of state authority, legal entities, regardless of ownership documents, conclusions, reference and other materials necessary to address the issues within the competence of the Ministry;
  • Request and receive from the Agency for Statistics under the President of the Republic of Tajikistan statistics on within the competence of the Ministry;
  • Organize the state control over observance of the Republic of Tajikistan legislation in the sphere of labor migration and employment;
  • Involve specialists of ministries and departments, scientific institutions to address the issues within the competence of the Ministry;
  • Approve normative and methodical acts on matters within the competence of the Ministry;
  • To submit to the Government of Tajikistan proposals on opening offices outside the Ministry of the Republic of Tajikistan;
  • In accordance with the legislation of the Republic of Tajikistan to submit proposals to the Government of Tajikistan on creation, reorganization and liquidation of the Ministry of system organizations, approve their regulations and statutes;
  • Submit proposals for the suspension and cancellation of orders, decisions and instructions of the ministries and departments, organizations, irrespective of their subordination and forms of property, contrary to the legislation of the Republic of Tajikistan on matters relating to the competence of the Ministry;
  • To hear at the meetings of the Board of the Ministry reports the representatives of ministries, departments and other economic entities in the territory of the Republic on matters relating to the competence of the Ministry;
  • To organize exhibitions, conferences, symposia, meetings and other events on matters within the competence of the Ministry;
  • Monitor compliance with financial discipline, the use of material and financial resources for their intended purpose organizations of the Ministry system.

Organization of the Ministry

7. The Ministry is headed by the Minister, shall be appointed, dismissed by the President of the Republic of Tajikistan with the subsequent approval of the Decree of the President of the Republic of Tajikistan Majlisi Oli.

8. The Minister shall manage the activities of the Ministry on the principles of undivided authority and is personally responsible for implementation of the tasks and functions of the Ministry.

9. The Minister has deputies, including one first, who shall be appointed and dismissed by the Government of the Republic of Tajikistan on the proposal of the Minister.

10. Minister of Labour, Migration and Employment of the Republic of Tajikistan:

  • Distribute duties between the first deputy and deputy ministers;
  • Within the limits set by the Government of the Republic of Tajikistan approves the number of employees of the central apparatus and payroll, staffing of the central apparatus of the Ministry according to the exemplary requirements, and cost estimates for its content, within the limits approved for the same period in budget allocations;
  • In the prescribed manner approves regulations on structural subdivisions of the central apparatus of the Ministry, as well as provisions and statutes organizations of the Ministry system.
