The Municipal Drinking Water and Sewerage Company of Guayaquil, EMPAG_EP, under municipal jurisdiction, controls and regulates the drinking water, sewage and stormwater services operated by the C.Ltda interagua concessionaire.
The rights and obligations of the user and Interagua C.Ltda. they are regulated by the Internal Regulation for the Management of Drinking Water, Sewerage and Storm Drainage Services in the Guayaquil Canton, published in the Official Gazette No.45 of June 14, 2010.
On October 1, 2012, it was published in Official Gazette No. 42 of the Municipal Autonomous Decentralized Government of Guayaquil (MI Municipality of Guayaquil), the ORDINANCE OF CONSTITUTION OF THE "PUBLIC MUNICIPAL PUBLIC COMPANY OF DRINKING WATER AND SEWAGE OF GUAYAQUIL, EP " , Discussed and approved by the MI Municipal Council of Guayaquil in ordinary and extraordinary sessions of dates 27 and 28 September 2012, in first and second debate, respectively; Art. 1 of the ORDINANCE OF CONSTITUTION OF THE "PUBLIC MUNICIPAL PUBLIC COMPANY OF DRINKING WATER AND SEWAGE OF GUAYAQUIL, EP" , provides for the creation of the municipal entity called "MUNICIPAL PUBLIC COMPANY OF DRINKING WATER AND SEWAGE OF GUAYAQUIL, EP"as a society governed by public law, with legal status and its own assets, budgetary autonomy, financial, economic, administrative and management; Subject to the relevant regulations of the Republic applicable in accordance with its specific purpose.
2.3. The MUNICIPAL PUBLIC COMPANY OF DRINKING WATER AND SEWAGE OF GUAYAQUIL, EP, is intended to assume the role that the Cantonal Water and Sewerage Company of Guayaquil, ECAPAG, has played as a contracting party, based on the contract signed by it with International Water Services (Guayaquil) Interagua C.Ltda., On April 11, 2001. Accordingly, it will be the responsibility of this municipal public company to comply with and enforce said contract and the effects derived therefrom within the framework of a strict respect for legal security.
2.4. On October 29, 2012, the Public Company of Potable Water and Sewerage of Guayaquil EP and the Cantonal Company of Drinking Water and Sewerage of Guayaquil (ECAPAG), signed an agreement, in compliance with the provisions of the third paragraph of the article two of the ORDINANCE OF CONSTITUTION OF THE "PUBLIC MUNICIPAL PUBLIC COMPANY OF DRINKING WATER AND SEWAGE OF GUAYAQUIL, EP", which establishes that the effective exercise of the competence described in the object of the public company, will be fulfilled immediately after the formalization of the legal instrument to be signed between these companies. Agreement that was signed on November 1, 2012 at the Fifteenth Notary Public of the Guayaquil Canton.
2.5. Through Resolution issued on November 1, 2012, signed by the General Manager of the Municipal Public Company of Drinking Water and Sewerage of Guayaquil, EP, in its numeral one paragraph two provides for the signing of agreements or instruments, through which the Public Company Municipal Drinking Water and Sewerage of Guayaquil, EP assumes the quality of contracting party of supervisors of work, of the laboratories to make contracts of quality of water and others, promotion and publicity of the services that as Entity of Control and Regulation lends, thus like all the Contracts subscribed by ECAPAG, for the exercise of its then role of entity of control and regulation of the concession, assumed by the Municipal Public Company of Potable Water and Sewerage of Guayaquil, EP.
