The Attorney General's Office, was created by Decree No. 36, (Published in La Gaceta No. 5, of August 31, 1979), which was attached to the Executive Branch of the Republic, had the legal representation of the State in that concerns the interests and matters that this Law determined, was in charge of the Attorney General and the Assistant Attorney General.

Law 346 creates the Organic Law of the Public Prosecutor's Office as an independent institution, with organic, functional and administrative autonomy, which is in charge of the accusatory function and the representation of the interests of the Society and of the Victim of the crime in the criminal process, through the Attorney General of the Republic, which will only be subordinated to the Political Constitution of the Republic and the laws.

On December 4, 2001, through Law No. 411, the " Organic Law of the Attorney General of the Republic " was created, in which it ceases to be called the Office of the Attorney General and is separated from the Public Prosecutor's Office, having both functional independence.

The latter is in charge of the legal representation of the State of the Republic of Nicaragua, with regard to the interests and matters that this Law determines, with specific functions of advice and consultation of the Bodies and State entities, its opinions will be mandatory compliance within the organs of the Executive Power.
