Created as soon as the first government is established in the aftermath of the recovery of independence, the General Secretariat of the Government is headed by the Secretary General of the Government, a member of the Government with the rank and prerogatives of the Minister.
By its functions, the general secretariat of the government is placed at the crossroads of State institutions. Its essential mission is to ensure the smooth running of government work.
As such:
- Coordinating the preparation of draft laws and regulations from the various ministerial departments, its mission is to ensure the progress of any draft text by verifying its conformity with the constitutional provisions and its compatibility with the laws and regulations in force as well as its translation into French. As such, its role is to accompany any draft text from the beginning of its conception until its publication in the official bulletin.
- And, as a legal adviser to the government, he gives his opinion on the legal questions put to him by the administrations and public institutions. For this purpose, it hears any consultation regarding the interpretation of the provisions of a text in the context of the general constitutional, legislative and regulatory context.
The General Secretariat of the Government is also responsible for ensuring the application of laws and regulations concerning, in particular, the right of association and certain regulated professions within its competence.
From the general secretariat of the government is placed the commission of the markets. This committee, chaired by a senior official, is responsible, inter alia, for giving its opinion on any draft text relating to public contracts, agreements, concessions or administrative acts involving the performance of a public service, as well as on any question concerning the preparation, procurement, execution, settlement and receipt of contracts.
