Cabinet of Minister of Ukraine Regulation 481 of September 23, 2014 Kyiv On approval of Regulation on the State Statistics Service of Ukraine The Cabinet of Ministers of Ukraine provides: Approve the Regulation on the State Statistics Service of Ukraine being attached. Acknowledge as becoming ineffective the decisions of the Cabinet of Ministers of Ukraine according to the list being attached. Regulation on the State Statistics Service of Ukraine - The State Statistics Service of Ukraine (SSSU) is a specially authorized central body of executive power in the area of statistics whose activity is directed and coordinated by the Cabinet of Ministers of Ukraine via the minister of economic development and trade and which implements the state policy in the sphere of statistics. - As to its activity, the SSSU is guided by the Constitution and Ukraine's laws, decrees of the President of Ukraine and regulations of the Supreme Council of Ukraine adopted according to the Constitution and Ukraine's laws, acts of the Cabinet of Ministers of Ukraine and other legislation acts. - The SSSU's main tasks are as follows:  1)    implement the state policy in the sphere of statistics 2)    put forward the proposals to the minister of economic development and trade about shaping the state policy in the sphere of statistics. - According to the tasks imposed on the SSSU, its commitments are as follows: 1)    summarize the practice to introduce the legislation on issues pertaining to its competence, develop the proposals about the improvements to the legislation acts, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, normative and legal acts of ministries and submit them to the minister of economic development and trade according to the established procedure; 2)    with the involvement of the state bodies and other legal persons concerned, develop and submit to the minister of economic development and trade the projects for long-term programs to develop the state statistics and annual plans for the state statistical observations; 3)    organize the implementation of the long-term programs to develop the state statistics and annual plans for the state statistical observations and submit the reports on their fulfilment to the minister of economic development and trade; 4)    approve statistical methodology and reporting and statistical documentation for statistical observations (apart from the state classifiers of technical and economic, and social information) as well as typical forms for primary recording documentation needed to undertake the observations; 5)    carry out management of all work related to the preparations for the population censuses and agricultural censuses, ensure the conduct of such censuses, processing, generalization, dissemination and uses of their results, develop and approve the censuses programs and census tools, the calendar plan to prepare and take censuses , census techniques, the concept for technology to process population census data, programs to produce census materials; 6)    establish information base to forecast and analyze the tendencies and regularities of social and economic development, compile  national accounts; 7)    ensure the compliance of statistical information with quality criteria, draw up reports for users on quality of statistical data; 8)    organize and carry out statistical observations over social and economic, and demographic phenomena and processes, ecological situation in Ukraine and its regions by collecting the forms of the state statistical reporting and undertaking specially tailored statistical observations (censuses, one-off recording, polls, sample surveys including those of the population (households);  9)    develop, improve and implement scientifically based statistical methodology; 10) ensure the creation and maintenance of the Unified State Register of Enterprises and Organizations of Ukraine and registers of respondents of statistical observations; 11) develop, improve and implement reporting and statistical documentation as well as typical forms for primary recording documentation needed to conduct statistical observations; 12) upon the recommendations of the state bodies, local authorities, other legal persons, coordinate the methodology and reporting documentation that are connected with the collection and uses of administrative data, data of banking, customs , financial statistics, balance of payments statistics, etc.; 13) ensure the methodological guidance of holding recording in rural communities; 14) compile the general table (list) and album of forms of the state statistical observations as well as typical forms for primary recording documentation needed to conduct the state statistical observations, list of reporting documentation connected with the collection and uses of administrative data; 15) supply respondents with reporting and statistical documentation (apart from the state classifiers of technical and economic, and social information) in line with the plan for the state statistical observations; 16) monitor and optimize the reporting burden per respondents; 17) use administrative data and other necessary information for statistical purposes, make agreements on exchange of information resources with the state bodies, local authorities and other legal persons that carry out the activities connected with the collection and uses of statistical information and administrative data; 18) provide the state bodies and local authorities with statistical information in volumes, forms and dates specified by the plan for the state statistical observations or selected decisions by the Cabinet of Minister of Ukraine; 19) monitor and satisfy the needs of users in statistical information; 20) ensure an equal access of users to statistical information and release the basic regulations on statistical methodology; 21) ensure the storage and protection of statistical information, observance of its confidentiality according to the legislation; 22) make fundamental research and application developments in the area of statistics; 23) ensure the development and implementation of the common technological approaches to collect, process and pass over statistical information on the basis of the common methodology and modern information technologies; 24) ensure the functioning and development of the integrated information and analytical system for the state statistics bodies; 25) ensure the introduction and functioning of system for quality management in the state statistics bodies; 26) ensure the usage of international statistical standards and recommendations in practice of the state statistics bodies; 27) carry out international cooperation on issues pertaining to its competence, participate in the preparations and make the relevant international agreements according to the procedure envisaged by the legislation; ensure the fulfilment of commitments to international agreements of Ukraine within the powers envisaged by the legislation; 28) within the powers envisaged by the legislation, conduct the actions on cooperation with the EU, make proposals about the adaptation of Ukraine's legislation in the sphere of statistics to the EU legislation; 29) make international and interregional statistical comparisons; 30) manage the objects of the state property that belong to the sphere of its management; 31) ensure training, re-training and upgrading the qualifications of producers and users of statistical information on issues pertaining to statistics, recording, reporting and application of modern information technologies; 32) ensure the social dialogue on issues concerning the implementation of the state policy in the sphere of labor relations, labor compensation, on-the-job safety and social protection; 33) consider the inquiries of citizens in issues related to the SSSU's activity, its regional bodies, enterprises, establishments and organizations that belong to the sphere of its management; 34) exercise the other powers specified by the law. - For the purpose of organizing its activity, the SSSU does the following things: 1)    within the powers envisaged by the law, conduct the actions concerning the prevention of corruption, and control their performance in the SSSU Headquarters, its regional bodies , at enterprises, establishments and organizations that belong to the sphere of the SSSU"s management; 2)    recruit staff for the SSSU Headquarters and senior positions at its regional bodies, enterprises, establishments and organizations that belong to the sphere of the SSSU management, form staff reserve for the relevant positions, organize the work on training, re-training and upgrading the qualifications of the government employees and workers of the SSSU Headquarters; 3)    organize the planning and finance work at the SSSU Headquarters, its regional bodies, enterprises, establishments and organizations that belong to the sphere of the SSSU management, control the use of financial and material resources, ensure the organization and improvements to bookkeeping accounting according to procedure established by the law;    4)    within the powers envisaged by the law, perform the tasks concerning the mobilization training and the country's mobilization readiness; 5)    within the powers envisaged by the law, involve citizens to participate in the management of the state affairs, effective interaction with institutions of civil society, make public control over the SSSU activity; 6)    organize records-keeping activities and archival storage of documents in the SSSU Headquarters according to the established rules. - To perform the tasks the SSSU charged with, it has the following rights: 1)    according to the procedure and dates established by the SSSU, obtain for free (apart from selected sample surveys of natural persons or the population of such persons where respondents are given the monetary compensation for the time spent) from all respondents covered by Ukraine's law on the state statistics, including central and local bodies of executive power, local authorities, banks, public associations, natural persons-entrepreneurs and natural persons subject to statistical observations, and make use of primary and statistical data, bookkeeping data, other information needed to carry out statistical observations including information with limited access as well as explanations attached to them; 2)    during the conduct of the state statistical observations over natural persons subject to such observations, apply the polling methods using phone and mail communications as well as the employees from the state statistics bodies and temporary staff involved into the conduct of statistical observations can visit their residential and economic dwellings and buildings, land plots, etc.; 3)    use the relevant information databases of the state bodies, the state system for the government call and other technical means; 4)    during the conduct of statistical observations, make use of electronic documents and electronic document flow by observing the legislation requirements to the protection of information within information systems; 5)    make expert's appraisal and calculations (estimates) of selected statistical indicators on the basis of the approved statistical methodology; 6)    explore the status of primary recording and statistical reporting, check the reliability of primary and statistical data given by respondents, and according to the procedure established by the SSSU, apply the method of direct visiting the production, service and other dwellings, sections of legal persons, independent units of legal persons located on the territory of Ukraine, as well as natural persons-entrepreneurs; 7)    made respondents insert corrections into statistical reporting, other statistical forms if there is false reporting and other distortions of primary and statistical data; 8)    put forward the proposals to the law enforcement bodies about bringing to justice envisaged by the law officials and natural persons who broke the requirements of Ukraine's law on the state statistics; 9)    consider the cases about administrative violations connected with the violation of procedure to submit and use data from the state statistical observations and impose the administrative punishments; 10) make comments on misuse or misinterpretation of statistical information; 11) convene meetings, set up commissions and work groups, run scientific conferences, seminars on issues pertaining to the SSSU competence;      12) involve temporary staff according to legislation to undertake statistical observations; 13) according to the established procedure, involve the specialists from central and local bodies of executive power, enterprises, establishments and organizations (subject to agreement with their chiefs), researchers, representatives from institutions of civil society (subject to their consent) to consider the issues belonging to the SSSU competence;   14) according to the legislation, submit statistical data to international organizations as well as exchange statistical information with the EU statistical bodies, international organizations as well as statistical services of foreign countries; - The SSSU exercises its powers directly and via the regional bodies created according the established procedure. - In the process of performing the tasks imposed on it, the SSSU interacts with other government bodies, auxiliary agencies and services set up by the President of Ukraine, temporary consultative, advisory and other auxiliary bodies created by the Cabinet of Minister of Ukraine, local authorities, bodies set up by the Cabinet of Ministers of Ukraine, local authorities, public unions, trade unions and organizations of employers, relevant bodies of foreign countries and international organizations as well as enterprises, establishments and organizations. - Within the powers envisaged by the law, on the basis of and in pursuance of the Constitution and laws of Ukraine, acts of the President of Ukraine and regulation of the Supreme Council of Ukraine, according to the Constitution and laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, decrees of the Ministry of Economic Development and Trade, the SSSU issues decrees, supervises their execution.  The SSSU normative and legal acts issued within its powers in pursuance of Ukraine's law on the state statistics, Ukraine-wide population census, and agriculture census are subject to the state registration according to the established procedure. The SSSU decrees issued within its powers envisaged by the law are compulsory for the execution by the state bodies, local authorities, legal and natural persons. - The SSSU is headed by the Chair who is appointed to this position and dismissed by the Cabinet of Minister of Ukraine upon the recommendation of the Prime Minister of Ukraine put forward on the basis of proposals by the minister of economic development and trade. - The SSSU's Chair has the following responsibilities: 1)    head the SSSU, manage its activity, represent the SSSU in relations with other bodies, enterprises, establishments and organizations within Ukraine and outside it; 2)    within the powers envisaged by the law, organize and supervise the execution of the Constitution and laws of Ukraine, acts of the President of Ukraine, acts of the Cabinet of Ministers of Ukraine and decrees of the Ministry of Economic Development and Trade within the SSSU Headquarters and its regional bodies; 3)    put forward the proposal to be considered by the minister of economic development and trade about shaping the state policy in the sphere of statistics, particularly, graft bills developed by the SSSU, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, decrees of the Ministry of Economic Development and Trade as well as position as to projects being produced by other ministries; 4)    ensure the performance of the SSSU decrees and instructions of the minister of economic development and trade on issues related to the sphere of the SSSU' activity; 5)    ensure the interaction between the SSSU and structural units of the Ministry of Economic Development and Trade responsible for the interaction with the SSSU; 6)    ensure observance the procedure established by the minister of economic development and trade concerning the exchange of information between the Ministry of Economic Development and Trade and the SSSU and the timeliness of its submission; 7)    report to the minister of economic development and trade about the performance of long-term programs to develop the state statistics and annual plans for the state statistical observations, tasks that the SSSU is responsible for, rectification of the violations and the removing of the shortcomings identified during the checks over the SSSU activity, its regional bodies as well as bring to justice the officials guilty in committing the violations. 8)    put forward to the minister of economic development and trade the proposals about appointment and dismissal of his deputies, distribute the responsibilities among his deputies; 9)    approve the regulation on independent structural units of the SSSU Headquarters; 10) approve the structure of the SSSU regional bodies upon the recommendation of the minister of economic development and trade; 11) approve staff schedule and budgets of the SSSU regional bodies;     12) upon the recommendation of the minister of economic development and trade, appoint and dismiss from positions the chiefs and deputy chiefs of independent structural units of the SSSU Headquarters; 13) according to the procedure envisaged by the legislation on the state service, appoint and dismiss from positions the government employees of the SSSU Headquarters; 14) employ and dismiss the SSSU employees according to the procedure envisaged by the legislation; 15) put forward to the minister of economic development and trade the proposals about the creation within the limit number of the government employees and the SSSU workers and funds meant for its keeping up as well as liquidation, re-organization by the Cabinet of Ministers of Ukraine of the SSSU regional bodies which are legal persons of public right; 16) upon the recommendation of the minister of economic development and trade and the heads of the relevant local state administrations, appoint and dismiss from positions the heads of the SSSU regional bodies; 17) upon the recommendation of the minister of economic development and trade, appoint and dismiss from positions deputy heads of the SSSU regional bodies; 18) set up, liquidate, re-organize enterprises, establishments, organizations, approve the regulation about them (statutes); according to the established procedure, appoint and dismiss from positions their heads; within the powers envisaged by law, exercise other functions on management of the state property's objects that belong to the sphere of the SSSU management;     19) abolish completely or partially acts of the SSSU regional bodies; 20) ensure the implementation of the state policy as for the state secrecy, control its protection in the SSSU Headquarters; 21) according to the established procedure, resolve the issues concerning the stimulation and bring to account the government employees and workers of the SSSU Headquarters , the heads of its regional bodies, give them ranks of the government employees; 22) according to the established procedure, recommend the government employees and workers of the SSSU Headquarters, its regional bodies to be awarded with the state decorations of Ukraine; 23) involve the government employees and workers of the SSSU regional bodies and with the consent of the heads, the government employees and workers from the ministries, other central bodies of executive power, local bodies of executive power, public authorities of the Autonomous Republic of Crimea , local authorities, enterprises, establishments and organizations into the consideration of issues that belong to the SSSU competence; 24) set up commissions, work and expert's  groups;      25) convene and conduct meetings on issues that belong to his competence; 26) sign the SSSU decrees; 27) within the powers envisaged by law, give instructions that should be implemented by the government employees and workers from the SSSU headquarters in a compulsory way; 28) exercise other powers stipulated by law. - The SSSU Chair has two deputies including the first one who are appointed to position and dismissed by the Cabinet of Ministers of Ukraine upon the recommendation of the Prime Minister of Ukraine, made on the basis of propositions by the minister of economic development and trade. - To prepare the recommendations as to performance of the SSSU's tasks, the board could be set up. The board's decisions can be implemented by issuing a relevant decree of the SSSU. To consider the scientific recommendations and conduct expert's consultations on the main issues concerning the activity, the SSSU can set up other permanent or temporary consultative, advisory and other auxiliary bodies. The decisions on setting up or liquidation of the board, other permanent or temporary consultative, advisory and other auxiliary bodies, their quantitative and persons composition, regulation are approved by the SSSU Chair. - The boundary number of the government employees and workers of the SSSU are approved by the Cabinet of Ministers of Ukraine. The structure of the SSSU Headquarters is approved by the SSSU Chair upon the recommendation of the minister of economic development and trade. The staff schedule and budget for the SSSU Headquarters is approved by the SSSU Chair upon the recommendation of the Ministry of Finance.  The SSSU is a legal persons of the public right, it has a seal with the image of the state emblem of Ukraine and its name, own forms, accounts at the Treasury.
