The objectives of this assignment are to;
Scope of Work
The scope of work for this assignment is detailed below:
a. Support the domestication of national agri-food systems and irrigation policies and laws: Facilitate the adoption and/or adaptation of national-level agriculture and irrigation policies, laws, and regulations, ensuring they are contextualized to meet the unique needs and priorities of each county. This includes the Agricultural Sector Growth and Transformation Strategy (ASTGS), BETA, the National Irrigation Policy, and other relevant policies and/or legal frameworks.
b. Strengthen county policy and legislative processes for agriculture and irrigation sectors: Provide guidance and technical assistance to counties in developing and reviewing their policies and legal frameworks. Ensure these frameworks align with national objectives while addressing local agricultural challenges, including climate resilience, food security, and sustainable irrigation.
c. Harmonization of regional, national and county agricultural policies: Facilitate dialogue and coordination between counties and national government agencies to ensure seamless integration of regional and national policies into county-level implementation, reducing overlaps and enhancing the efficacy of agri-food systems and irrigation laws and policies.
d. Capacity building for county policy and legal teams: Organize training and workshops to enhance the capacity of county legal and policy teams, ensuring they have the skills and knowledge required to draft, implement, and monitor effective agricultural and irrigation laws and policies.
e. Assist counties in implementing policies and legal frameworks: Provide technical assistance in the rollout of county-specific Agri-food systems and irrigation policies, ensuring these policies lead to actionable programs. This includes support for the design of county-led initiatives on climate-smart agriculture, irrigation projects, value chain development, and market access improvement.
f. Promote county-level adoption of legal innovations: Recommend and assist counties in adopting best practices and legal innovations from other regions or national frameworks that can enhance agricultural productivity and climate resilience at the local level.
g. Facilitate inter-county knowledge exchange: Encourage cross-county collaboration and the sharing of best practices, especially on successful domestication of regional, national policies, irrigation laws, and agriculture-related legal frameworks. Facilitate forums for county officials to learn from each other’s experiences.
h. Develop M&E frameworks for domesticated policies: Design monitoring frameworks to track the progress of counties in implementing domesticated agricultural and irrigation policies. These frameworks will ensure that national objectives on food security, irrigation, and market access are being met at the county level.
i. Track policy outcomes and legal reforms: Compile and analyze data on the impact of policy and legal reforms at the county level, identifying challenges and gaps in implementation. Provide recommendations for adjusting legal frameworks or policy approaches to address any shortcomings.
j. Provide periodic reports to the CoG Agriculture Committee: Submit reports to the Council of Governors Agriculture Committee detailing the status of policy domestication efforts, legal reform progress, and the outcomes of county-level agricultural policy reform initiatives.
Qualifications and Experience
Requirements for the qualifications, expertise, and experience of the consultant.
i. Academic qualifications
a) Must have an undergraduate degree in law. A master’s degree is highly preferred.
b) A minimum of 10 years of relevant professional experience with an understanding of agricultural laws, food security, devolution, social and economic development, governance, and markets in Kenya.
c) Demonstrated experience in leading or supporting the development of agricultural legislative frameworks, analytical work, and advocacy efforts.
d) Track record in conducting research, analytics, and developing data collection systems in the agriculture sector in Kenya.
e) Understanding of country and county governments’ legislative frameworks related to food security and markets.
ii. Experience of the consultant in similar assignments
a) Minimum 10 years of experience in stakeholder engagement, strategic partnership development, agribusiness development, women and youth empowerment, or development consulting in Kenya.
b) Proven track record in designing and implementing stakeholder engagement and mobilization strategies, mainly targeting women and youth in agriculture.
c) Demonstrated experience in conducting sector analysis, including identifying barriers and enablers affecting women agripreneurs’ access to resources, markets, and finance.
d) Familiarity with gender-responsive and inclusive approaches to entrepreneurship and agribusiness development.
e) Experience working in Kenya, with a strong understanding of the local cultural, policy, and economic contexts.
f) Experience collaborating with local organizations, government entities, private sector partners, and development institutions.
g) Demonstrated success in stakeholder engagement and relationship management across public and private sectors.
iii. Key Skills/Competencies
i) High understanding of the devolved system of governance.
ii) High understanding of the country’s agricultural system and markets as well as legal frameworks.
iii) High understanding of legal drafting
iv) Good research and analytical skills; and
v) Ability to generate comprehensive and informative reports.
The broad purpose of this consultancy service is for the consultant to undertake a critical review of the county agricultural legislative framework to identify potential strengths, weaknesses, gaps and synergies to help guide the design of county agricultural legislations and to provide critical laws and regulations by counties to promote, develop and regulate agricultural sector adequately.
iv. Key tasks and assignments include the following:
a) Critically document, review and analyze county agricultural laws in at least 20 counties.
b) Assess the impact of existing county laws and regulations on agricultural development, Marketing and financing.
c) Assess the coherence, compliance, alignment and robustness of the county legislative frameworks with regional or continental and global agricultural development frameworks.
d) Examine/analyze legislative gaps, interventions in crop sector that can increase productivity, promote trade and strengthen county food security and nutrition programs.
e) Develop model legislations to support counties in promoting, developing, and regulating the crop sector.
