Job Description:

The Phase 2 Project Management Unit will provide expert project management, technical, financial and environmental services which include among others; drafting Terms of Reference (TOR), procurement and appointment of consultants and service providers, and contract administration and management of the implementation of the Feasibility Study for LHWP Phase II Hydro-power component. The PPA Legal Advisor will be appointed on a part-time basis to provide expert support to the PMU in the terms of the Power Purchase Agreement. More specifically, the PPA Legal Advisor:

  • will assist with the review of the submissions made by the prospective consultants and evaluate their bids, including preparation of the bid evaluation report and submission to the Client, as well as participation in negotiations, as necessary, to achieve the objective of an award to a fully compliant consultant;
  • after the award to the consultant or service provider/s, the Advisor will provide short-term management and oversight support to the Hydropower Discipline Lead/or deputy as and when required for the day to day management of the consultant to achieve the contracted result in terms of quality and deliverables within the programmed time; and
  • To provide thought leadership on the application of natural resources economics in developing country contexts.
  • To develop Power Purchase Agreement (PPA) and reach agreement between Lesotho and Eskom
  • To develop a PSS once the PPA is in place
  • To manage regional commercial integration, focusing on developing regional and national electricity regulatory frameworks and identifying legal and institutional reforms.
  • Provide Legal advice to assist in the selection of the appropriate project development strategy and contract structure.
  • To advise Lesotho on relevant legal and commercial foundation required for the power purchase agreement
  • Coordinate with country-specific and regional networks of lawyers and advocates, business community leaders, and stakeholder organizations
  • Develop an initial understanding on how independent power should be developed and regulated and then assist LHDA in finding the policy experts.

Requirements:

  • A law degree or an advanced degree in a related field
  • Experience in the development of Power Purchase Agreements (PPA) for Independent Power Producers (IPP),
  • A minimum of ten years previous work experience in international development, including short or long-term field experience.
  • Working knowledge of the legal systems of Southern Africa
  • Superior judgment, diplomacy, and discretion on politically sensitive and/or high profile projects
  • Experience working in developing countries.
  • Efficient report writing abilities.
  • Proven ability to develop and maintain sound working relationships with government officials, public and private sector organizations, and other stakeholders.
  • Proven ability for accuracy under pressure and adherence to deadlines.
  • High-level interpersonal, negotiation and communication skills, including experience in cross-cultural environment and international settings.
  • Commitment to teamwork and collaborative work practices.
  • Competency in computer skills with adequate knowledge of Microsoft Office and Outlook.
  • Excellent command of English, written and spoken
