Transitional Justice is the discipline in the field of human rights that refers to the ways in which countries that leave behind periods of conflict and / or repression use to confront massive or systematic human rights violations, of such magnitude and gravity, that the The judicial system not only cannot but is also inadequate to give them a full and effective response.

Transitional Justice did not originate from a grand conceptual design. It dealt with the experience observed in the measures adopted by countries, mainly in Latin America and Eastern Europe, that were moving from dictatorial or totalitarian regimes to more democratic systems. Transitional Justice raised the complex legal and political questions about what kind of justice could be expected in times of transition.

In 2004, the then UN Secretary General, Kofi Annan, in his report presented to the Security Council defined Transitional Justice as: “[T] he variety of processes and mechanisms associated with the attempts of a society to solve the problems stemming from a past of large-scale abuse, in order to hold those responsible to account for their actions; serve justice; and achieve reconciliation. Such mechanisms can be judicial or extrajudicial and have different levels of international participation (or lack it altogether) as well as include the prosecution of persons, redress, the search for the truth, institutional reform, background investigation, removal of the position or combinations of all of them. "
